Farmora Kangals · Milledgeville, Georgia
This is a draft prepared for review by a Georgia attorney. It is not legal advice and must not be published or given to a buyer until an attorney licensed in Georgia has reviewed and approved it. Items marked [OWNER TO CONFIRM] are business decisions that must be made before review.
1. What this guarantee covers
Farmora Kangals guarantees that, at the time the puppy leaves our farm, the puppy is in good health to the best of our knowledge and has received the routine veterinary care described in Section 3.
We further guarantee the puppy against congenital or hereditary defects that are life-threatening or that render the dog unable to live a normal life, for a period of [OWNER TO CONFIRM: coverage period — commonly 12 or 24 months] from the date of purchase.
A defect is covered only if:
- it is diagnosed in writing by a licensed veterinarian;
- the veterinarian states in writing that the condition is congenital or hereditary in origin;
- the diagnosis is provided to Farmora Kangals within thirty (30) days of the diagnosis; and
- the Buyer has met all obligations in Section 4.
2. What this guarantee does not cover
This guarantee does not cover:
- Internal or external parasites of any kind, including coccidia, giardia, worms, mites, ticks and fleas. These are common in puppies and are readily treatable.
- Kennel cough, coccidiosis, giardiasis, and other common transmissible conditions.
- Parvovirus, distemper, or other infectious disease diagnosed more than [OWNER TO CONFIRM: 5 or 7] days after the puppy leaves our farm.
- Any condition arising from injury, accident, neglect, abuse, improper nutrition, improper housing, or failure to provide veterinary care.
- Any condition arising from or aggravated by the dog being overweight, over-exercised during growth, or worked before physical maturity.
- Umbilical hernia, cosmetic faults, coat colour or markings, bite or dentition, cryptorchidism, and any condition that does not materially affect the dog's health or quality of life.
- Temperament, working ability, guardian instinct, or suitability for any particular purpose. See Section 6.
- Any veterinary costs, transport costs, or other expenses incurred by the Buyer.
Hip and elbow dysplasia. [OWNER TO CONFIRM — read this section carefully with your attorney.] Our dogs are not OFA certified and have not undergone hip or elbow radiographic evaluation. Hip and elbow conformation in large breeds is influenced by growth rate, nutrition, exercise and body weight as well as genetics. If dysplasia is to be covered at all, the covered condition, the qualifying age, the required imaging standard, and the required body-condition history must all be defined here. If it is not covered, that must be stated plainly. Leaving this section vague creates an open-ended obligation.
3. Care provided before the puppy leaves our farm
Each puppy has received:
- Routine veterinary examination
- Age-appropriate vaccinations
- Age-appropriate deworming
- [OWNER TO CONFIRM: microchip — yes or no]
- [OWNER TO CONFIRM: health certificate for travel, where applicable]
Written records of the above are provided to the Buyer at the time of pickup or delivery.
Our dogs are not registered with any kennel club and no registration papers are provided. No genetic screening panel, OFA evaluation, or other diagnostic testing beyond routine veterinary care has been performed, and none is claimed.
4. Buyer's obligations
This guarantee is void unless the Buyer:
- Has the puppy examined by a licensed veterinarian within [OWNER TO CONFIRM: 72 hours / 3 business days / 5 business days] of taking possession, and provides Farmora Kangals with a copy of that examination record on request.
- Keeps the dog current on vaccinations and parasite prevention as recommended by the Buyer's veterinarian, and retains records.
- Feeds a complete and balanced diet appropriate to a large-breed dog during growth, and does not allow the dog to become overweight.
- Provides adequate shelter, secure fencing, fresh water, and routine veterinary care.
- Does not resell, rehome, or transfer the dog to a third party without first notifying Farmora Kangals. See Section 7.
5. Remedy
If a covered defect is established under Section 1, the Buyer's sole and exclusive remedy is:
[OWNER TO CONFIRM — choose one and delete the others:]
- Option A — Replacement. A replacement puppy of comparable quality from a future litter, when one becomes available. The Buyer keeps the original dog. Transport of the replacement puppy is at the Buyer's expense.
- Option B — Partial refund. A refund of [percentage]% of the purchase price. The Buyer keeps the original dog.
- Option C — Return and refund. Return of the dog to Farmora Kangals in exchange for a full refund of the purchase price. Transport is at the Buyer's expense.
The Buyer is not required to euthanize the dog to claim under this guarantee.
Farmora Kangals is not liable for veterinary expenses, transport costs, lost income, emotional distress, or any other direct, indirect, incidental or consequential damages.
6. No guarantee of working ability or temperament
Kangal dogs are livestock guardian dogs. A guardian dog's performance depends on how it is raised, socialised with stock, supervised, corrected, and managed by its owner over a period of one to two years or more.
Farmora Kangals makes no guarantee, express or implied, that any puppy will:
- guard livestock effectively;
- exhibit any particular temperament as an adult;
- be suitable for any particular property, livestock species, climate or management system; or
- be suitable as a companion, family, or property-protection dog.
The Buyer accepts the puppy with full knowledge that guardian behaviour develops over time and is substantially shaped by the Buyer's own management.
7. Return to breeder
If at any point in the dog's life the Buyer is unable or unwilling to keep the dog, the Buyer agrees to contact Farmora Kangals before rehoming, selling, surrendering, or otherwise transferring the dog.
Farmora Kangals will make reasonable efforts to assist in placing the dog and reserves the right of first refusal to take the dog back. [OWNER TO CONFIRM: whether any refund accompanies a return, and under what circumstances. Typically none.]
Under no circumstances is the dog to be surrendered to a shelter, animal control, rescue organisation, or auction.
8. Disclaimer of other warranties
[ATTORNEY — this section disclaims implied warranties. Georgia law governs whether and how implied warranties under the Uniform Commercial Code may be disclaimed in a consumer sale of an animal, and what language and conspicuousness are required. Please draft or approve this section directly.]
Except as expressly stated in this document, Farmora Kangals makes no other warranty of any kind.
9. Governing law
This guarantee is governed by the laws of the State of Georgia. [ATTORNEY — venue and dispute resolution clause to be drafted.]

Notes for the attorney
- Georgia has no pet purchase protection statute comparable to the "puppy lemon laws" in some other states, to the best of our understanding. Please confirm and advise whether any Georgia consumer protection provision applies to this sale.
- These dogs are unregistered. No kennel club registration, no pedigree documentation, no OFA or genetic panel testing. The site and all sales material state this plainly. The guarantee must not imply otherwise.
- Hip and elbow dysplasia (Section 2) is the highest-risk clause. Kangals are a large breed; without radiographic screening of the parents, any coverage commitment here is open-ended. Please advise.
- Section 6 is important to the seller. Buyers of livestock guardian dogs sometimes expect a finished working dog. This section must be enforceable.
- Section 8 requires your direct drafting.
