The Buyer acknowledges that this dog is not registered with any kennel club, that no registration papers or pedigree documentation exist or will be provided, and that no such documentation was represented at any point during the sale.

Deposit terms. [OWNER TO CONFIRM — this needs a clear decision:]

  • Is the deposit refundable? Under what circumstances?
  • Does the deposit transfer to a future litter if the Buyer changes their mind?
  • What happens if the Seller cannot supply a puppy (litter smaller than expected, puppy dies, puppy retained)?

A deposit does not transfer ownership. Ownership transfers only when the balance is paid in full and the Buyer takes possession.

4. Pickup, delivery and transfer of ownership

Puppies are available to go home from eight (8) weeks of age.

Risk of loss and all responsibility for the dog pass to the Buyer at the moment of collection or, where the Seller arranges transport, at the moment the dog is handed to the carrier.

5. Buyer's representations

The Buyer represents and warrants that:

  1. The Buyer is at least eighteen (18) years of age and is purchasing the dog for themselves, not as an agent for an undisclosed third party.
  2. The Buyer has read and understands the Health Guarantee provided with this Agreement.
  3. The Buyer understands that Kangal dogs are large, powerful livestock guardian dogs bred to work independently, and that they require secure fencing, space, and consistent management.
  4. The property where the dog will live has [OWNER TO CONFIRM: fencing requirement — e.g. "adequate perimeter fencing"].
  5. The dog will not be kept chained or tethered as its primary means of confinement.
  6. The dog will not be used for dog fighting, baiting, or any illegal purpose, and will not be sold or transferred to any person the Buyer knows or suspects intends such use.
  7. The Buyer will comply with all local ordinances regarding dog ownership, licensing, and vaccination.

6. No guarantee of working ability

The Buyer acknowledges that the Seller makes no guarantee that this dog will guard livestock, exhibit any particular adult temperament, or prove suitable for the Buyer's specific property, livestock, or management system.

Guardian behaviour develops over one to two years or more and depends substantially on how the dog is raised, introduced to stock, supervised and corrected by the Buyer.

7. Breeding

  • Option A — No restriction. The dog is sold with full breeding rights. The Buyer may breed the dog at their discretion.
  • Option B — Spay/neuter required. The Buyer agrees to have the dog spayed or neutered by ______ months of age and to provide written veterinary proof. [Note: early spay/neuter in large breeds is a contested topic; the age chosen should be discussed with a veterinarian.]
  • Option C — Companion/guardian only, no breeding. The dog is sold on the condition that it is not bred. Remedy for breach: [to be defined].

Whichever option is chosen, the Seller makes no representation that the dog is of breeding quality, and no registration papers exist to support any breeding programme.

8. Return to breeder

If at any time the Buyer is unable or unwilling to keep the dog, the Buyer agrees to notify the Seller before rehoming, selling, surrendering or otherwise transferring the dog. The Seller retains a right of first refusal.

The dog is never to be surrendered to a shelter, animal control, rescue organisation, or auction.

9. Limitation of liability

Once the dog is in the Buyer's possession, the Buyer assumes full responsibility for the dog's care, containment, behaviour and actions.

The Seller is not liable for any injury, damage or loss caused by the dog after transfer of possession, nor for any veterinary expense, transport cost, lost income, or other direct, indirect, incidental or consequential damages.

10. Entire agreement

This Agreement and the accompanying Health Guarantee constitute the entire agreement between the parties. No verbal representation made before or during the sale forms part of this Agreement. Any amendment must be in writing and signed by both parties.

11. Governing law

This Agreement is governed by the laws of the State of Georgia.

Notes for the attorney

  1. Legal entity (Section 1). The seller's structure needs to be settled before this contract is used. A sole proprietor signs personally and carries personal liability.
  2. Deposit terms (Section 3) are currently undecided. This is the clause most likely to be disputed in practice.
  3. Unregistered dogs. No kennel club registration, no pedigree, no OFA or genetic screening. The website, the listings and this contract all state this plainly and none of them may imply otherwise.
  4. Sections 9 and 11 require your direct drafting.
  5. Breeding restriction (Section 7) — if a restriction is chosen, please advise on a remedy that is actually enforceable in Georgia. Liquidated damages clauses in animal sales are frequently challenged.
  6. Please advise whether Georgia requires any seller disclosure, licensing, or record-keeping for a person selling dogs from a residence or farm at this volume.
